  • Accounts are often frozen when money received is linked to a cyber fraud complaint, even if you did nothing wrong.
  • Trade on registered platforms, accept payments only from the verified buyer’s own account and wait for cleared funds.
  • If frozen, get the written order, collect your trade records and take legal advice early.

Is P2P crypto legal in India? Peer-to-peer crypto trading is not separately banned. It is part of the same legal picture as other crypto activity: lawful, taxed and monitored. The real risks are practical. Bank accounts that receive money from P2P buyers are frequently frozen when the money is linked to a fraud complaint, and many traders discover this only after their account is blocked.

This guide explains the legal position, why accounts get frozen, how to trade more safely, what to do if your account is frozen and the tax rules that apply. It is general information and not advice on any specific freeze. If your account is frozen, take advice quickly, because the steps and deadlines depend on the order and the agency involved.

India has no law that bans crypto or peer-to-peer trading. The Supreme Court struck down the Reserve Bank’s 2018 restriction on banks serving crypto businesses in March 2020. Since then, the law has dealt with crypto through tax and anti-money laundering rules. So if you are asking is P2P crypto legal in India, the answer is that it is not prohibited, but it is not regulated as a product either.

A P2P platform connects buyers and sellers who agree on a price and settle payment directly, usually by UPI or bank transfer, with the platform holding the crypto in escrow. Platforms that operate in India are expected to register with FIU-IND as virtual digital asset service providers and to follow know-your-customer rules. Offshore P2P platforms that serve Indian users are on weaker ground.

Tax applies as for any crypto transfer. Gains are taxed at 30% with no deduction other than cost, and a 1% TDS may apply to certain transfers, though its application to P2P trades can be unclear. The tax law does not turn on whether a trade is P2P. The safe course is to treat every sale as a taxable transfer and keep full records. That is the full answer to is P2P crypto legal in India on tax.

Why accounts get frozen

The usual cause is a cyber fraud complaint. Fraudsters steal money and send it through chains of accounts. If a P2P buyer pays you with stolen money, the victim’s complaint can lead police or a bank to place a freeze or a lien on the receiving account, often for the amount in question, but sometimes for the whole account. You may never have met the fraudster, and you may have done nothing wrong, yet the account is blocked. This is the main practical risk behind is P2P crypto legal in India questions.

Other triggers include many incoming payments from unrelated parties, rapid in-and-out transfers, payments from accounts that are flagged, use of a personal account for what looks like business activity, and mismatches between the name on the payment and the name of the platform user. Banks use automated monitoring and may freeze on a trigger, or on a request through the national cyber crime reporting system.

Legal powers sit behind these freezes. Under the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced the Code of Criminal Procedure, police may seize property suspected to be linked to an offence, and courts can order attachment. Banks also freeze under their own policies and under anti-money laundering rules. The scope and duration differ, which is why you need to read the exact notice you receive.

How to trade more safely

Use platforms that are registered in India and publish clear dispute rules. Prefer trading with verified counterparties with a long history, and read the payment instructions carefully. Insist that payments come from an account in the same name as the verified buyer. Refuse payments from third parties, and refuse to release crypto until the money has fully cleared in your own account, not just when a screenshot is shown.

Keep amounts and patterns reasonable, and use a separate bank account for trading, with a clear record of each trade. Save chat logs, screenshots, order IDs, the counterparty’s details and bank statements. If a buyer pays and then raises a dispute, or a payment looks odd, pause and use the platform’s dispute process before you release the crypto. Be cautious of offers well above market price, urgent requests and anyone who asks you to move the chat off the platform.

Safer P2P habits
HabitWhat to doWhy
Use a registered platformCheck FIU registration and dispute rulesBetter recourse
Match payer and platform nameAccept payments only from the verified buyer’s own accountThird-party payments are a fraud sign
Wait for cleared fundsRelease crypto only after funds clear in your accountScreenshots can be faked
Separate accountUse a dedicated bank account for tradingLimits the impact of a freeze
Keep recordsChats, order IDs, bank statements and KYCNeeded to lift a freeze

Think about alternatives. Buying and selling through an exchange with bank transfers in your own name is less exposed to third-party payment risk than P2P. For businesses, a formal account and invoicing helps. If your trading is frequent, speak to a tax adviser about whether it is a business. Remember that is P2P crypto legal in India is a different question from is it safe for my bank account.

What to do if your account is frozen

First, find out what has been frozen and why. Ask the bank in writing for the order or request, the authority that made it, the amount and the date. Check whether it is a freeze on the whole account or a lien on a specific amount. Keep your account statement and the trade records ready. If a police station or cyber cell is involved, ask for the complaint number and the officer in charge.

Second, respond quickly with documents. Show that you sold crypto in the ordinary way, with the platform’s order record, the buyer’s verified details, your KYC, proof that you transferred the crypto and tax records. Contact the investigating officer and offer to cooperate. Many freezes are lifted or limited after the account holder proves a genuine trade, though the process can take weeks or months.

Third, use legal remedies if needed. You can apply to the magistrate or the court that has jurisdiction for release or de-freezing, and in some cases file a writ petition in the High Court against an arbitrary or disproportionate freeze. Courts have in some cases ordered release of amounts not linked to the alleged offence. A lawyer experienced in banking and criminal procedure can advise on the best route. Do not ignore any notice.

Next steps and quick answers

Before your next P2P trade, check that the platform is registered, use a dedicated account, verify the payer’s name, wait for cleared funds and keep records. If your account is frozen, get the written order, collect your documents, contact the officer and take legal advice early. Report your gains for tax in any case. This is general information, not legal advice for your situation.
